At a Glance

This page explains how Wullup takes publicly accessible event information in order to show it to users of the Wullup app. It is addressed in particular to organizers, clubs, venues, and cultural institutions whose events appear on Wullup. We have deliberately written it in plain language.

This notice is available in English and German. In case of discrepancies, the German version prevails.

1. What We Do

Wullup takes public event information from publicly accessible sources and shows it to users of the Wullup app so they can discover local events.

1.1 Which Details We Take

We take only factual, event-related details:

  • Title of the event
  • Date and time (start, and end where stated)
  • Location — name of the venue, address, and city
  • Price or admission information, where publicly stated
  • Category of the event (e.g. concert, club, festival, culture)
  • Organizer or venue, along with the public reference to the source

1.2 From Which Sources

  • Public Instagram event calendars of venues and organizers
  • Publicly accessible venue websites and event calendars

We access only content that is publicly available without logging in, without circumventing technical protection measures, and without any access restriction. Private accounts, closed groups, and password-protected areas are not read.

1.3 Naming the Organizer

Organizers are named. Every event we take identifies the organizer or the venue, so that users can see at any time who is running the event. Wullup does not act as the organizer and does not give the impression that it is hosting the event itself.

2. What We Do NOT Do

2.1 No Taking of Flyers, Images, and Original Text

  • No images or flyers: We do not take flyers, artwork, photos, or other image material from third-party sources without the express permission of the rights holder
  • No original text: We do not take description text, announcements, or post text verbatim without the express permission of the rights holder
  • Newly written descriptions: Description text in the Wullup app is written anew on the basis of the factual details alone. It is not a copy of the original text

Pure factual information — that an event takes place at a particular time in a particular place — does not enjoy copyright protection. The creative form in which an organizer publishes that information does. That is why we keep the two strictly separate.

2.2 Automated Checking and Respect for Reservations

For websites, we check automatically before every retrieval whether the operator has objected to automated analysis. We check and respect:

  • robots.txt — exclusions for automated retrieval under the Robots Exclusion Standard
  • Machine-readable text and data mining reservations within the meaning of § 44b(3) UrhG (Art. 4(3) of Directive (EU) 2019/790), for example via tdm-reservation entries, corresponding meta tags, or HTTP headers
  • Terms of use of the source, insofar as they prohibit automated analysis

If there is a reservation, the source is not read. The exclusion is enforced technically and applies for as long as the reservation exists. Once a reservation has been detected, upcoming events already taken from that source are also removed.

2.3 Further Limits

  • No personal profiles: We do not create profiles of people who are mentioned in public posts
  • No circumvention of technical protection measures: No logging in, no captcha circumvention, no access to non-public areas
  • Considerate retrieval: Retrievals are made at a moderate frequency so as not to burden the source systems

3. Notice on the Use of AI (Art. 50 EU AI Act)

When preparing event information, Wullup uses automated systems that rely on artificial intelligence. Under Art. 50 of Regulation (EU) 2024/1689 on artificial intelligence (KI-VO / EU AI Act), we expressly disclose this:

Event descriptions in the Wullup app are generated automatically with the help of AI.

The use of AI is limited to the wording and categorization of the factual details we take. Its purpose is to produce an independent, consistently worded description from pure factual information — and not to reproduce third-party text.

Limits of automation: Automatically generated descriptions can contain errors. The organizer's own information always prevails. Please report inaccuracies to us at [email protected] — we correct them promptly. Organizers can also manage their events themselves at any time (see Section 6).

4. Legal Basis and Retention Periods

4.1 Legal Basis

We process publicly accessible event data on the basis of our legitimate interest under Art. 6(1)(f) GDPR.

Our legitimate interest: informing the public about local events. Wullup brings scattered event listings that are publicly accessible anyway together in one place, so that people can find what their city has to offer culturally.

Balancing: The details we process were published by the organizer themselves — precisely in order to reach an audience. No special categories of personal data under Art. 9 GDPR are processed and no personality profiles are created. Naming the organizer serves the organizer's visibility. You can object at any time and informally (see Section 5).

4.2 What We Store

We store only event-related details within the meaning of Section 1.1, together with the technical reference to the source.

4.3 Retention Periods

Original post text is used only as a transient intermediate step in processing and is not kept permanently. Retrieval logs serve traceability, troubleshooting, and proof that reservations were respected.

5. Objection and Opt-Out

Organizers and venues can object to our taking their information at any time.

5.1 How to Object

You can object informally — simply send us an email at [email protected]. It is enough to tell us which Instagram account, which website, or which venue is concerned. No proof and no reasons are required; you can also object under Art. 21 GDPR at any time.

5.2 What Happens Next

We implement objections within 72 hours:

  • Future taking is blocked — the source is locked technically and is not read again
  • Upcoming events already taken are removed — they no longer appear in the Wullup app

We confirm the implementation to you by email. The block stays in place permanently until you expressly tell us that you want it lifted.

5.3 Copyright Complaints

If you believe your rights in an image or text have been infringed, you can additionally report this through our Copyright and DMCA Policy.

6. Managing Events Yourself — Wullup Backstage

Instead of objecting — or in addition to it — organizers can manage their events themselves through Wullup Backstage. That way you keep full control over the title, description, image material, ticket links, and updates, and your information always takes precedence over automatically taken information.

The Organizer Terms apply to the use of Backstage.
